DIFC Court

1.DIFC Courts:

 

  • Jurisdiction

    : DIFC Courts have jurisdiction over cases related to the DIFC free zone, which is a financial hub in Dubai. They handle civil and commercial disputes arising within the DIFC and are independent of the mainland UAE legal system. Any party can opt for the jurisdiction of the DIFC Courts for civil and commercial matters.

 

  • Laws

    : DIFC Courts operate under a common law system and follow principles of English common law. They have their own set of laws, known as DIFC laws, which are distinct from the UAE’s federal and local laws. Proceedings are conducted as per the DIFC Court Rules.

2.Mainland UAE Courts:

 

  • Jurisdiction:

    Mainland UAE courts handle a wide range of civil, commercial, and criminal cases that are not specific to the DIFC or other free zones. They apply UAE federal and local laws.

 

  • Laws:

    The legal system in the mainland UAE is based on a combination of civil law and Islamic law (Sharia). It follows a different legal framework compared to the DIFC Courts. The proceedings are conducted as per the UAE Civil Procedures Law.

 

  • Judges:

    Mainland UAE courts are staffed by judges who are familiar with the UAE’s civil and Sharia law system. Proceedings are typically conducted in Arabic.

 

  • Enforcement:

    Judgments from mainland UAE courts are enforceable throughout the UAE.

 

3.Arbitration:

 

  • Jurisdiction:

    Arbitration is a form of alternative dispute resolution. Parties can agree to arbitrate disputes, and the arbitration process is often used for international commercial disputes.

 

  • Laws:

    Arbitration in the UAE can be conducted under the UAE Federal Arbitration Law or, if applicable, the DIFC Arbitration Law, which is based on international standards. The proceedings are conducted as per the UAE Arbitration Law or Arbitration Centre Rules.
