Article (251)

In the case of a lessor of real property attaching movable property of sub-tenants under the provisions of Paragraph (2) of Article [247] of this Code, proceedings must be conducted against the head tenant and sub-tenant.

Moreover, this allows for the automatic extension of the attachment to the rent held by the sub-tenant, as the attachment document is served onto the sub-tenant.

If the head tenant has a right to sublet, then the sub-tenant can request that the movable property be released while the rent attachment remains with the person doing the attachment. UAE criminal law for forgery criminal law in the UAE also involves these kinds of transactions and protects all parties in this transaction.

Article (263)

The creditor can enact a garnishment of the assets he keeps for the obligor himself, after obtaining an order from the competent judge. They must then serve notice to the debtor, which includes all particulars required under a garnishment notice.

If they do not have such an execution writ or judgment, they must comply with the processes and timelines prescribed in Clauses (2, 3, 4, 5) of Article [250] of this Code. These financial actions are regulated by Fraud Dubai laws as well to prevent misuse and safeguard legal rights.

Legal Consequences of False Accusations and Forgery: Criminal Law in the UAE

Making a false claim in the UAE comes under the very provisions for ‘false accusations’ of the UAE Penal Code. In this article, we will discuss the treatment for false allegations or false accusations under UAE law and what the punishment will be for that.

Punishment under the federal Decree-Law No. 31/2021 on the Issuance of the Crimes and Penalties Law (the UAE Penal Code) is prescribed for making false reports to judicial or administrative authorities.

Violators can be faced with jail time, fines, or both. Courts in the UAE will consider false accusation cases regarding the perception of bad faith. Moreover, if the false claim results in the conviction of another person, the fabricator incurs the same penalty.

This can be punished under Article 324, for reporting false crime, accident, or risk to a judicial or administrative authority knowingly, with six months’ jail, a fine, or both. The forgery criminal law is also related to falsified documents or falsified evidence. Moreover, in the UAE, punishment for forgery incorporates strict punishments like jail time and heavy fines to prevent fraudulent activities.

Forgery Criminal Law

Penalties for False Accusations and Forged Evidence under UAE Criminal Law

Pursuant to Article 325, a person who, with malevolent and ill intent, makes false allegations before any judicial or administrative authority, accusing an individual of having committed an act requiring a criminal or administrative sanction.

Even where the allegation results in no criminal or disciplinary record, the accused is still liable. Besides, those who falsely create material evidence to accuse someone of committing a crime, or, with fraudulent intent, initiate legal proceedings against an innocent person, must be sentenced to imprisonment, a fine, or both.

The court shall impose both imprisonment and a fine if the alleged crime amounts to a felony. Also, if the false claim results in a conviction for a felony sentence, the penalty for the falsely accused shall be the same as the false accuser.

The same goes for filing a false claim with forged documents, as it attracts severe punishment under forgery criminal law. The Act provides that forging a document is altering the truth in the manner mentioned above with the intent to use it as a genuine document to cause harm.

UAE has strict laws for fraud of all kinds, which include imprisonment and heavy fines as a punishment to deter the act. Moreover, UAE criminal law punishes false accusations, as well as fraud. One of these crimes is fraud, which is common in Dubai, where a person uses false facts or documents to make a false and malicious representation of a person worthy of punishment.

Conclusion

Finally, the UAE Penal Code takes a firm stance against false accusations and forgery, with strong penalties for anyone who engages in fraudulent behavior. Articles 251-263 deal with the attachment of movable property, garnishments, and the legal implications of false claims. If people make false reports or create fabricated evidence, they face imprisonment, a fine, or both, which is aggravated if the fabricated crime leads to a felony conviction.

Under forgery criminal law, forgery happens: the punishment is heavy even for falsification of documents, etc. The rules are there to protect from fraud, false claims, and to protect the legal rights against these, and to maintain justice in the UAE.
