  • Renewal: Trademarks are valid for 10 years, with a six-month grace period for renewal, extendable by three more months under certain conditions.

Patent Protection

Patents protect inventions that are novel, involve an inventive step, and are industrially applicable. The UAE patent system is governed by Federal Law No. 11/2021 and Cabinet Decision No. 6/2022. Within the wider scope of intellectual property law in the UAE, patents are crucial for encouraging innovation. Key points include:

  • Eligibility: Patents are granted for inventions that are new, inventive, and industrially applicable. Exclusions include scientific theories, business methods, and certain biological processes.

  • Registration Process: Applications are filed with the Ministry of Economy, followed by formal and substantive examination, publication, and issuance of a certificate if approved.

  • Term: Patent protection lasts for 20 years from the filing date.

  • Administrative Authorities: The Ministry of Economy and the Department of Economic Development conduct inspections, investigations, and take enforcement actions.

  • Digital Enforcement: In 2024, the Ministry of Economy, in collaboration with the Telecommunications and Digital Government Regulatory Authority (TDRA), introduced new mechanisms such as the “InstaBlock” initiative. This allows rapid blocking of infringing websites and live broadcasts, enhancing protection for digital content and creative works.

  • Dispute Resolution: A dedicated committee now expedites copyright disputes and grievances, facilitating faster resolutions before court involvement.
